Ramasubramanian) The application for reference moved by the Revenue was actually rejected by the Customs, Excise and Gold (Control) Appellate Tribunal. But on a copy of the order rejecting the application for reference this Court appears to have numbered the reference and also issued notice to the assessee. Therefore, virtually there is no reference. Hence the reference is closed.
