Sri Roodi Apparao v. Kum. Roodi Vasantha Rani And Anothers
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.5136 OF 2011 ORDER:
In spite of the matter being posted under the caption 'for dismissal', none appears for the petitioner.
2.
Heard the learned counsel for the 1st respondent and learned Public Prosecutor for the 2nd respondent and perused the record. 3.
This Petition is filed by the petitioner seeking for quash of order dated 26.04.2011 passed in Criminal Revision Petition No.38 of 2010 on the file of VIII Additional District Judge (FTC), Visakhapatnam. 4.
By virtue of the said order, the learned Judge dismissed the Petition which was filed impugning the order in Crl.M.P. No.666 of 2010. The said order resulted in enhancement of the maintenance from Rs.500/- to Rs.1,500/- to the 2nd petitioner therein, who is the daughter of the petitioner herein. The lower Court by virtue of probabilities considered the monthly income of the petitioner herein as Rs.27,000/- p.m. and enhanced the said amount. There is absolutely no error in the approach of the said Court in the said order. Hence, no merits are found in this Petition. With the above observations, the Criminal Petition is dismissed. Interim stay granted by this Court on 28.06.2011 in Crl.P.M.P. No.5205 of 2011 shall stand vacated. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
