THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9199 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.106 of 2023 on the file of Mellacheruvu Police Station, Suryapet District, registered for the offences under Sections 341, 307 and 427 r/w. 109 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner was arrested on the allegation of beating the injured on his head with an iron rod on 30.07.2023. It is alleged in the complaint that in a pre-planned manner, this petitioner and two others have attacked the injured. It is admitted in the complaint that there are certain disputes regarding the land.

Learned counsel for the petitioner would submit that there are no grievous injuries which were received by the complainant. However, there are pending civil disputes pursuant to which false complaint was filed.

Learned Additional Public Prosecutor on instructions would submit that the injured received laceration injury on the scalp which was simple in nature.

Keeping in view that the petitioner is in jail since 08.08.2023 and there are civil disputes regarding a passage in an agricultural land, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:

i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate, Huzurnagar.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
