THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10788 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.10 seeking grant of anticipatory bail in crime No.81 of 2015 on the file of the Gangavaram Police Station, Cittoor District, registered for the offences under Sections 307, 353, 109, 120-B IPC, Sections 29 and 32 of the Forest Act, read with Rule 3 of the A.P.Sandalwood Transit Rules, Section 29 of the Wild Life (Protection) Act and Sections 55(2) and 58 of the Biological Diversity Act, Sections 3 and 5 of the Prevention of Damages to Public Property Act, Sections 24(A), 24(B) and 27 of the Arms Act. Heard and perused the material available on record. The allegation against the petitioner herein is that the petitioner was found in possession of two red sandal logs weighing about 78 kgs.
Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the crime. In view of the facts and circumstances of the case and also as the petitioner is having previous cases, this Court is not inclined to grant anticipatory bail to the petitioner herein.
