THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE N. BALAYOGI WRIT PETITION No. 5054 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the applicant in O.A.No.3403 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. By interim order dated 07.07.2015 passed therein, the Tribunal suspended the proceedings dated 25.06.2015 issued by the District Educational Officer, Warangal, and directed him to continue the petitioner as a School Assistant. The Tribunal further made it clear that its interim order would not preclude the authorities from proceeding against the petitioner in the disciplinary action taken by the Department.

Seeking implementation of the aforestated order, the petitioner has approached this Court by way of this writ petition. Learned Government Pleader for Services (Telangana), having secured instructions in the matter, informed this Court that the aforestated order passed by the Tribunal was not subjected to challenge by the authorities.

That being so, in terms of the undertaking given by the learned Advocate General for the State of Telangana, which was recorded by the Division Bench of this Court comprising the Hon'ble The Acting Chief Justice and the Hon'ble Sri Justice U. Durga Prasad Rao in its order dated 30.09.2016 in W.P.No.31905 of 2016, the respondents are bound to implement the aforestated order passed by the Tribunal.

The Writ Petition is accordingly disposed of directing respondents 1 and 3 to abide by and implement the interim order dated 07.07.2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.3403 of 2015. This exercise shall be completed expeditiously and, in any event, not later than two (2) weeks from the date of receipt of a copy of this order.
