Heard Mr.P.Vengala Reddy for petitioner. No representation for respondents. In spite of granting time on 30.09.2016 and 29.11.2016, the respondents neither filed counter-affidavit nor represented by the counsel.
The petitioner prays for the following relief: " .....this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in passing the impugned letter dated 05.09.2016 by directing the 3rd respondent to take action against the petitioner vehicle is illegal, arbitrary and against the principles of natural justice and consequently direction the respondents 2 and 3 to release the petitioner vehicles Lorry bearing No. AP-21-TT-1337 and pass....." Through the letter impugned in the writ petition, the 2nd respondent addressed letter to 3rd respondent to take appropriate action against the seized vehicle i.e., lorry.
Having regard to the nature of writ prayer, without entering into merits of the matter, the writ petition is disposed of by this order. The petitioner is given liberty to represent to the 3rd respondent for release of the vehicle under applicable Government Orders within one week from today and on such representation being made, the 3rd respondent shall pass order within one week thereafter on the said representation.
