COMMON ORDER:

C.P.No.161 of 2014 is filed for an order to wind up the respondent for nonpayment of the debt allegedly due to the petitioner. By order, dated, 22.12.2014, this Court has admitted the company petition and ordered publication of the same and accordingly, publication has been made. The petitioner has filed C.A.No.499 of 2015 under Rule 100 of the Companies (Court) Rules, 1959, for permission to withdraw the company petition. In the affidavit filed in support of this application, it is, inter alia, stated that after the company petition was admitted, the respondent has approached the petitioner, upon which the dispute has been settled and accordingly, the respondent has paid the debt amount of Rs.3,00,000/- (Rupees three lakhs only) to the petitioner. The petitioner has, therefore, sought leave of the Court to withdraw the company petition.

In the light of the above facts, C.A.No.499 of 2015 is allowed and consequently, C.P.No.161 of 2014 is dismissed as withdrawn. As a sequel to dismissal of the company petition, company application Nos.899 to 901 of 2014 shall stand disposed of as infructuous. __________________________ (C.V.
