ORDER
This writ petition is filed seeking the following relief: "...to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the case of the petitioner for the Notional promotion to the post of Additional Director of Medical, Health and Family Welfare Department is illegal, arbitrary against the principles of natural justice and violation of Articles 14, 16 and 21 of the Constitution of Indian and consequently consider the case of the petitioner for the notional promotion to the post of Additional Director of Medical Health and family welfare department and pass such order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard Sri A.Sai Chakravarthy, learned counsel appearing for the petitioner and learned Government Pleader for Medical Health and Family Welfare appearing for the respondents.
It is the case of the petitioner that he is fully eligible to be promoted to the post of Additional Director of Medical and Health Services. But the respondents are not considering his case. Hence, he submitted a representation to the respondents on 05.09.2019. But the respondents are neither considering his
case for promotion nor passing any orders on the representation submitted by him.
Learned Government Pleader appearing for the respondents contended that since the representation submitted by the petitioner is pending with the respondents, the respondents would consider the same and pass appropriate orders, in accordance with law.
Having considered the rival submissions made by the learned counsel on either side, this Writ Petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 05.09.2019 and pass appropriate orders, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, pending, if any shall stand closed.
