THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION NO.1019 OF 2015 ORDER:

The petitioner herein, who was working as an Anganwadi Worker of Nyampalli Village, Pedapadu Mandal, West Godavari District, calls in question the orders passed by the Project Director, District Women and Child Welfare Organisation, West Godavari District, on 05.01.2015 removing her from duties as an Anganwadi Worker.

It appears, when the husband of the writ petitioner was carrying in his auto the rice bag of 50 kgs, the villagers have suspected that he is removing the rice bag meant for the Anganwadi Centre to blackmarket. The explanation offered by the writ petitioner as well as the Supervisor was that one rice bag meant for Vutluru Centre has been wrongly delivered at Nyampalli Centre and hence, the Supervisor has instructed the rice bag to be delivered to Vutluru Centre and for that purpose only, the rice bag is sought to be carried in the auto of the husband of the writ petitioner, whereas the villagers have suspected that the petitioner and her husband have removed the rice bag for the purpose of diverting it to black-market.

There appears to be something that can be said in the matter. The respondents have suspected the bona fides of the petitioner. Since the controversy is a factual controversy, it would be more appropriate for the petitioner to approach the District Collector by way of an appeal against the orders of the Project Director, so that the facts as alleged by the petitioner can be got thoroughly verified and thereafter a decision can be taken by the Collector, as to confirm the order passed by the Project Director or modify the same appropriately. Therefore, the petitioner is granted fifteen (15) days time from today to file a detailed appeal/representation before the District Collector, who, upon receipt of the same, the Collector may get the facts verified through any of his responsible officers and based upon

the analysis of the facts, appropriate decision, either confirming the order passed by the Project Director or modifying the same, be passed as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order. The Writ Petition stands disposed of, accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
