HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.21447 of 2017 ORDER:

Heard learned counsel for the petitioner and also the learned Government Pleader for Civil Supplies representing the respondents and perused the prayer in the writ petition with the supporting affidavit including the panchanama dated 22.06.2017 and the representation of the petitioner to the Collector (CS)-2nd respondent dated 24.06.2017.

The prayer in the writ petition is as follows: "To issue writ of mandamus declaring the action of the respondent No.3 in seizing the premises of the petitioner without conducting proper measurement of kerosene oil stopped the supply of kerosene oil to the petitioner on valid authorization which is neither suspended nor cancelled the authorization of the writ petitioner consequent upon panchanama dated 22.06.2017 and without disposing of the representation dated 24.06.2017 as being illegal, arbitrary and violative of principles of natural justice and further direct the respondents herein to appoint District Supply Officer or any officer to conduct proper enquiry to see the available kerosene oil measuring with dip rod to find real variation of stocks of the petitioner whole sale out let point 2 tankers and to pass such other order or orders."

The main grievance of the petitioner is that his representation dated 24.06.2017 is not attending. Having regard to the above and in the result, the Writ Petition is disposed of directing the respondents to dispose of the said representation of the petitioner within three (03) weeks from the date of receipt of a copy of this order. The petitioner is also directed to appear before the Collector (CS) on 07.07.2017, for the

Dr. SSRB,J Collector (CS) to fix the date and complete the enquiry on the representation meantime.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
