Heard learned counsel for the parties.
Learned counsel for the petitioner does not press this C.R.P. on merits and seeks direction to the Tribunal to dispose of O.S.No.111 of 2012 within time frame.
Mr.M.A.K.Mukheed, learned Standing Counsel for respondent No.2, submits that for the present, Presiding Officer of the Tribunal is not available and the said post is vacant. Having regard to the submissions of learned counsel for the parties, I am satisfied that the following order shall meet the ends of justice.
"C.R.P. is disposed of as not pressed. The Tribunal shall endeavour to dispose of O.S.No.111 of 2012 as expeditiously as possible and preferably within a period of one year from the date of appointment of the Presiding Officer. All contentions on merits are kept open. It is needless to mention that the Tribunal shall decide the suit on merits in accordance with law and uninfluenced by the observations made in the impugned order."
Consequently, miscellaneous petitions, if any, also stand disposed of.
