THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32322 OF 2011 ORDER:
Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue. With consent of both the counsel, the present writ petition is disposed of at the admission stage.
2. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 1st respondent in not granting status quo orders in Appeal No.Rc.E/3150/2011 in respect of the land to an extent of Ac.2.30 cents out of Ac.5.29 cents in Survey No.121/C situated at Anantapur Rural within the S.R.D. and R.D. of Anantapur, as illegal and arbitrary, and consequently direct the respondents to grant status quo orders in the above said land.
3. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the Joint Collector, Anantapur, to dispose of the appeal filed by the petitioners vide R.C.E/3150/2011, at the earliest.
4. Learned Government Pleader for Revenue submits that he has no objection for the same provided the appeal is still pending.
5. Having regard to the circumstances stated above, the Writ Petition is disposed of directing the Joint Collector, Anantapur (Respondent No.1) to dispose of the Appeal No.Rc.E/3150/2011, in accordance with law, at the earliest preferably within a period of
eight (08) weeks from the date of receipt of a copy of this order. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
