HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17243 of 2017 ORDER:

1) The present writ petition came to be filed with the following relief:

" issuance of writ of mandamus declaring the action of the second respondent in interfering with peaceful possession and enjoyment of the property to an extent of Ac.0.54 cents in Sy.No.187/ 6 and Ac.1.53 cents in Sy.No.190/ 4 of Brundavanam Village, Mundlamur Mandal, Prakasam District at the instance of the third respondent, is illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India;

and consequently to direct the third respondent not to interfere with the civil disputes between the petitioner and the third respondent." 2) Though various grounds raised learned counsel for the petitioner submits that the respondent-police are interfering with the peaceful possession and enjoyment of the petitioner over the property. The same is disputed by the Government Pleader for Home (AP) and on instructions she states that respondent Nos.1 and 2 are not interfering with the civil disputes. 3) In view of the submissions made, the writ petition is disposed of directing the second respondent not to interfere with the civil disputes between the petitioner and third respondent. But if any action is sought to be taken against any of the parties the same shall be in accordance with the provisions of law.

4) There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
