HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.14829 OF 2005 ORDER :

When the matter came up for hearing, the learned counsel for the petitioner submitted that the petitioner has obtained loan from the 3rd respondent and the petitioner has repaid the entire loan, but, in spite of the petitioner paying the entire loan amount, the respondents have initiated proceedings to recover the same from the salary of the petitioner. In those set of circumstances, the petitioner has filed this Writ Petition and this Hon'ble Court, vide orders dated 20.07.2005, was pleased to grant interim directions not to deduct the loan amount from the salary of the petitioner. The learned Counsel for the petitioner further submits that during the pendency of Writ Petition, the petitioner has attained the age of superannuation and he has retired from service. 2.

This Court is of the considered view that this Writ Petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within one week from the date of receipt of a copy of this order to settle his loan account and upon such representation being received, the respondents shall consider and pass appropriate orders in accordance with law within a period of four weeks thereafter.

With this observation, Writ Petition is disposed of. 4.
