2017-11-07S.V.Bhatt1 pages

HON'BLE SRI JUSTICE S.V. BHATT W.P. No.14057 OF 2013 ORDER:

No representation for petitioner.

Heard the Assistant Government Pleader (Home). The petitioner prays for Mandamus declaring action of respondents in trying to dispossess the petitioner from an extent of Ac.1-29gts. in Survey No.136/ A, Ac.0-11gts. in Survey No.161/ A and Acs.3-21gts. in Survey No.163/ A at Malkapur Village, Kondapur Mandal, Medak District without any right as illegal and arbitrary. I have gone through the affidavit and also the annexures relied on by the petitioner. This Court is of the view that the instant prayer is too general, and in respect of civil disputes where the petitioner perceives interference either by 4th respondent or respondents 2 and 3 acting at the instance of respondent No.4 without recourse to law, ought to work out remedies in a properly instituted suit either before competent civil Court or before the Wakf Tribunal. This Court is of the view that the averments as stand today and annexures relied on by the petitioner are not satisfactory to entertain the writ petition.

The writ petition fails and is dismissed.

Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT, J Date: 07.11.2017 Stp
