THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7221 OF 2017 ORDER:

Heard learned counsel for the petitioner/A2 of C.C.No.1196/2009, pending on the file of Additional Judicial First Class Magistrate of Sangareddy of Medak District, taken cognizance for the offences punishable under sections 342, 353 and 506 IPC and also heard the learned public prosecutor representing the respondents of whom 2nd respondent is the District Collector and perused the grounds urged in the quash petition and the another bench order of this Court dated 27.09.2016, in Crl.P.No.5560 of 2015, quashing the proceedings against A1.

Even from the police final report covered by the investigation under part II case diary, the allegation is against A1 of running a parallel government and not even allowing to talk to the children in his control and there is nothing against the petitioner or A3 and this Court another bench categorically observed of even reading of the entire allegations so far as A1 in quashing the proceedings for no case made out.

Having regard to the above and the petitioner is in better footing for no substance of any allegation against him to attract any of the criminal provisions, this criminal petition

is allowed, quashing the proceedings against him and also against A3, though not a party.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
