This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.1 to 4 in the event of their arrest in Crime No.64 of 2022 on the file of Station House Officer, Bazar Hatnoor Police Station, Adilabad District registered for the offences punishable under Sections 306, 294(b) and 506 read with Section 34 of Indian Penal Code and Section 3(1)(s), 3(2)(V) of SC/ST Act. 2.

Heard learned counsel for petitioners/Accused Nos.1 to 4 and learned Assistant Public Prosecutor for respondent-State. Learned Assistant Public Prosecutor submits that notice served on the 2nd respondent. Perused the record.

The case against the petitioners is that the deceased earlier worked as agricultural labour in the fields of these petitioners. On 06.08.2022 it is alleged that the petitioners abused the deceased in the name of his caste and also threatened him with dire consequences for not coming to work. Thereafter, the deceased consumed unknown pesticide resulting in his death.

Learned counsel for the petitioners submits that the only allegation against these petitioners is that they have abused the deceased asking him to come for work, for which reason, it is alleged that the deceased had consumed some pesticide. 5.

In the said circumstances, when the overtact attributed to these petitioners is one of intimidation, they can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 to 4 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.1 to 4 are directed to surrender before the Station House Officer, Bazar Hatnoor Police Station, Adilabad District within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.1 to 4 shall appear before the concerned Station House Officer on every Monday between 10.30

AM and 01.00 PM for a period of eight (08) weeks or till filing of charge sheet whoever is earlier.

iii) The petitioners/Accused Nos.1 to 4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 6.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
