THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 29023 OF 2014 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader appearing for respondent Nos. 1 to 3. 2.

The prayer sought in the Writ Petition is as under: " ....to grant writ of mandamus or any other writ or direction in the nature of the writ declaring the action of the respondent No. 3 in involving the civil disputes in between the petitioner and the Respondent No. 4 and there by locking the door of the house of the petitioner situated at Plot bearing No.2 admeasuring 100 sq. yards in survey No 403/ 1 & 420 situated at Moula Ali, Ranga Reddy District acquired through the Andhra Pradesh Wakf Board on 27.12.2012 through proceedings No.F.No.R3/ 1213/ RR/ Rent/ 2012 as illegal, arbitrary, contrary to law and violative of the Articles 14 and 300-A of the Constitution of India and consequently direct the respondent No.3 not to interfere in civil disputes in between the petitioner and respondent No. 4 ."

The grievance of the petitioner is that respondent No.3 is involving in civil disputes between the petitioner and respondent No.4 in connection with plot bearing No.2, admeasuring 100 sq.yds in Sy.Nos.403/ 1 and 420 situated at Moula Ali, Ranga Reddy district. 4.

Learned GP placed on record, the written instructions dated 7.10.2014 issued by the Sub-Inspector of Police, Malkajgiri P.S., Cyberabad Commissionerate.

A perusal of the said instructions would reveal that on 6.9.2012, one Sri K.Anjaiah, Police Constable, lodged a complaint with Malkajgiri P.S. and requested to take necessary action against two groups who were quarrelling with each other. In connection with the same, a case in Cr.No.613 of 2014 for the offence under Section 160 IPC has been registered and investigation was taken

up. Except the registration of the above said crime against both the groups disturbing public peace and tranquillity in the locality, respondent No.3 never interfered with the civil disputes between the petitioner and respondent No.4. The petitioner, only to divert the attention of the investigating agency to prevent him from taking any action against him, filed the present Writ Petition. 6.

In the light of the above, this Court is of the opinion that no further orders are required in the Writ Petition. 7.

The said written instructions are placed on record. 8.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
