HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42610 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the respondents 1 and 2 in frequently calling to police station, without there being any case against the petitioner, as illegal and arbitrary, and consequently, direct the respondents not to interfere with the personal life and liberty of the petitioner.

Heard and perused the material available on record. The case of the petitioner is that the 7th respondent took an amount of Rs.1,00,000/ - and Rs.50,000/ - from him and issued a cheque for Rs.1,00,000/ - as security for repayment of the amount.

Subsequently, when the petitioner asked for repayment of the said amount, the 7th respondent along with his son i.e. 8th respondent threatened him with dire consequences and since the 7th respondent is a retired employee of the police department, he is instigating the respondents 1 and 2 to harass the petitioner and the 1st respondent took the petitioner into custody and obtained his signatures on four blank promissory notes worth Rs.12,00,000/ - each, and also the 3rd respondent is insisting him to pay the amount due to the 7th respondent under the said promissory notes.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, this Court is inclined to pass the following order:

The respondents 1 and 2 are directed not to harass the petitioner and not to call him to the police station, without there being any complaint for cognizable offence, against the petitioner. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
