There is no representation for the petitioner or his learned counsel.

The matter has been pending on the file of this Court for over a decade and the petitioner is also enjoying an interim order. However, there is a clear lack of diligence in prosecuting the matter though the same is listed for final hearing. This necessarily constrains this Court to draw the inference that the petitioner is not interested in pursuing the matter.

The writ petition is accordingly dismissed for non-prosecution. Interim order dated 16.11.2004 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
