THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5745 OF 2016 ORDER:

This Criminal Petition is filed by the petitioners-A1 to A6 & A8 under Section 482 Cr.P.C. seeking to quash the proceedings against them in Crime No.90 of 2015 on the file of Muthukuru Police Station, SPSR Nellore District, registered for the offence punishable under Sections 447 and 506 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that the petitioners and others trespassed into the office of Tahsildar for distributing pamphlets, containing the matter defaming the image of Tahsildar, in the premises of the office of Tahsildar. When the office subordinate stopped them, all the accused threatened him with dire consequences and threw the pamphlets in the premises of the office.

Learned Counsel for the petitioners submitted that the petitioners and others are fighting against the establishments on the environmental issues and therefore, those establishments bore grudge against them and at their instance, the Tahsildar filed this false complaint.

The grounds raised by the learned Counsel for the petitioners do not necessitate to interfere with the investigation in the above crime. Accordingly, the Criminal Petition is dismissed. The 1st respondent-police are at liberty to complete the investigation and file a final report, in accordance with law. If the petitioners are aggrieved over the report that would be filed by the 1st respondent-police, they are at liberty to approach this Court.
