THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.4889 OF 2013 ORDER:

This writ petition is filed challenging the notice dated 21.01.2013 issued under Section 452 (2) of the Hyderabad Municipal Corporation Act, 1955 (for short, 'the Act') on the ground that to notice issued under Section 452 (1) and 461 (1) of the Act, petitioner submitted explanation but no decision is made and without considering the explanation, notice under Section 452 (2) of the Act could not have been issued.

At the time of admission, no interim order was granted. 3.

Since the issue pertains to the year 2013, the Writ Petition is disposed of directing the respondent - Municipal Corporation to take further course of action as warranted by law, if no action is taken already, by affording reasonable opportunity to the petitioner. It may call upon petitioner's explanation and on due consideration of the same, pass appropriate orders in accordance with law. Till such decision is made, no coercive action shall be initiated against the petitioner pursuant to the impugned notice. Pending miscellaneous petitions shall stand closed. _____________________ P.
