HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT APPEAL No.943 OF 2018 JUDGMENT (ORAL) : (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard the learned Government Pleader for Forest (TS) appearing for the appellants, Sri A. Prabhakar Rao, learned counsel for respondent Nos.1 and 2 and the learned Government Pleader for Revenue appearing for respondent No.3.

2. The impugned order proceeds on the basis that there was a direction to produce a joint inspection report. The joint inspection report appears to be of the forest and revenue officials.

3. In the circumstances now obtained, the appellants will be at liberty to move the learned single Judge for vacating the order impugned in this appeal on production of further materials and placing on record an affidavit or a counter affidavit, if not already presented. The Writ Appeal is so ordered without prejudice to the contentions of both sides before the learned single Judge. We clarify that it will also be open to the learned single Judge to dispose of the writ petition itself finally. That may be done untrammelled by anything stated in the impugned interlocutory order.
