THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9826 OF 2015 ORDER:
This petition is filed by the petitioners-accused Nos.1 and 2 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.1881 of 2011 on the file of the XVI Metropolitan Magistrate, Cyberabad, Kukatpally.
Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 448, 323 and 506 IPC. It is alleged that A1, who is the owner of a Shutter bearing Municipal No.25-35/B/C, situated on NH: 9, Ramachandra Reddy Nagar, Ramachandrapuram Medak District entered into a rental deed with the complainant on monthly rental basis of Rs.2,000/-. When A1 started demanding him to pay monthly rentals at the rate of Rs.10,000/-, the complainant expressed his inability. On that, A1 threatened him that he will forcibly evict him from the premises. When the complainant went to his native place, the shutter locks put by the complainant were replaced with other locks. When the complainant asked A1, he necked him out and locked the shutter. Then, the complainant gave a report, on the basis of which a case was registered. While so, A1 and A2 criminally trespassed into his house, threatened him, forced him to sign on a receipt and beat him.
Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to grant the relief sought by the petitioners.
At this stage, the learned Counsel for the petitioners has sought for dispensing with the presence of the petitioners before the trial Court.
Considering the above submission, the presence of the
petitioners before the trial Court is dispensed with except on the date of framing of charges and on the date of examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment in the above C.C. The petitioners are directed to be represented by a Counsel before the trial Court on all hearing dates. Accordingly, the Criminal Petition is disposed of.
