HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.2067 of 2017 O R D E R :

This contempt case is filed alleging violation of order, dated 26-12-2016 passed by this Court in WP.No.17690 of 2009.

Learned counsel for the petitioner submits that services of the similarly situated persons were regularized, but the petitioner was denied the same. He further submits that though the respondent issued proceedings on 01-12-2017, the same is not in tune with the order passed by this Court and as such, the respondent has violated the order of this Court.

On the other hand, learned Standing Counsel for the respondent-Corporation basing on the counter affidavit submits that there was some delay in implementing the order because the concerned authorities took time for tracing the files. He further submits that though the petitioner mentioned the names of other persons, but their services were not regularized except two persons and those two persons services were also regularized erroneously and action was initiated for reviewing the case those two persons. It is to be seen that this Court gave direction to consider the case of the petitioner for the regularization of services by taking into consideration of the orders passed in respect of similarly situated persons and in pursuant to the same, the

respondent issued proceedings dated 01-12-2017. Though learned counsel for the petitioner tried to attack the said proceedings on merits, this Court does not go into said aspects in the contempt case.

In view of the same, I do not see any violation of orders passed by this Court.

Accordingly, the Contempt Case is dismissed. However, it is open for the petitioner to challenge the proceedings dated 01-12-2017 in accordance with law.

As a sequel thereto, miscellaneous applications, if any, pending in this case, shall stand closed.
