Putta Koulsalya v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRL.P. No.13129 OF 2013 ORDER:
This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioners/A.2, A.3, A.5 and A.6 seeking to quash proceedings in C.C. No.570 of 2012 on the file of the Additional Judicial Magistrate of First Class, Sangareddy, wherein the petitioners and A.1 and A.4 are charge sheeted for the offences under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.
2. When the matter came up for hearing today, learned counsel for the petitioners produced copy of the order in Crl.P. No.7822 of 2015 and submitted that the said petition was filed by A.1 and A.4 to quash the proceedings in C.C. No.570 of 2012 and the same was allowed in view of the compromise memo in Crl.P.M.P. No.7728 of 2015 filed by the de facto complainant and A.1 and A.4 and, therefore, the present petition filed by the petitioners/A.2, A.3, A.5 and A.6 who stand on the same footing may be allowed and the proceedings against them may also be quashed.
3. There is no representation for respondent No.2-de facto complainant.
4. A perusal of copy of the order dated 03.09.2015 in Crl.P.M.P. No.7728 of 2015 shows that the
proceedings in C.C. No.570 of 2012 were quashed against A.1 and A.4 in view of the compromise petition in Crl.P.M.P. No.7728 of 2015 filed by the de facto complainant and A.1 and A.4. In that view of the matter, I find no reason to continue the proceedings against the petitioners/A.2, A.3, A.5 and A.6.
5. Accordingly, this Criminal Petition is allowed and the proceedings in C.C. No.570 of 2012 on the file of the Additional Judicial Magistrate of First Class, Sangareddy, are quashed against the petitioners/A.2, A.3, A.5 and A.6.
6. As a sequel, miscellaneous petitions, if any pending in this petition, shall stand closed. _________________________ U. DURGA PRASAD RAO, J 18th April, 2016 siva
