THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.35784 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondents in not releasing the pensionary benefits of the petitioner, as illegal and arbitrary.

2. The case of the petitioner is that though he retired from service on 30.09.2013, his pensionary benefits are not released and as such, he filed representations, dated 23.12.2013 and 18.09.2015, but in spite of the same, the respondents have not released the pensionary benefits on the ground that criminal cases are pending against him. He asserts that his name is not mentioned in the complaint filed by respondent No.2 against whom disciplinary proceedings were initiated and he is not concerned with the same. Since no action is taken on the representations made by him and his pensionary benefits are not released, the present Writ Petition is filed.

3. Heard learned counsel for the petitioner and learned Government Pleader for Services.

4. In view of the facts and circumstances, without expressing any opinion on merits, respondent Nos.1 and 3 are directed to dispose of the representations, dated 23.12.2013 and 18.09.2015, of the petitioner in accordance with law and take action, accordingly, within

a period of three (3) months from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. ___________________________ A. RAJASHEKER REDDY, J October 24, 2016.
