Komatireddy Narayana v. Syed Hafeez Uddin

HON'BLE MRS JUSTICE ANIS SAMP NO. 1043 of 2016 AND SECOND APPEAL No. 1157 OF 2009 JUDGMENT :

Appellants Sri Komatireddy Narayana S/o Lasmaiah and Sri Komatireddy Budamma w/o Lingaiah (died) and their Counsel Sri N. Ashok Kumar are present. Respondent Sri Syd Hafeez Uddin S/o Muneer Uddin and his Counsel Sri Mirza Nisar Ahmed Baig is present. Heard both sides and perused the petition.

It is submitted that at the intervention of elders, parties have settled the matter and a separate Memorandum of Compromise under Order 23 Rule 3 read with Section 151 CPC is also filed and as per the terms of compromise, the Second Appeal may be allowed. Having regard to the above said submission and also considering the fact that the respondent herein is a senior citizen, this Second Appeal is allowed in terms of compromise entered into between the parties. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
