HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3708 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Accused under Section 482 Cr.P.C seeking to quash the proceedings in C.C. No.444 of 2014 on the file of IV Additional Junior Civil Judge-cum-Judicial Magistrate of the First Class, Chittoor.

2) Heard, the learned counsel for Petitioner and the 1st respondent-State represented by the learned Public Prosecutor before admission of the application under Section 482 Cr.P.C and before any notice to the 2nd respondent-defacto-complainant at this stage to quash the proceedings.

3) The petition is disposed of giving liberty to the petitioner to move for any discharge petition while hearing the charges to decide with any other remedy thereunder and also file an application under Section 205 Cr.P.C to dispense with personal appearance and in such an event, the learned Magistrate shall allow the application by dispensing with the personal appearance of the accused with necessary conditions.

4) Subject to the observations, the criminal petition is disposed of.
