THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40325 of 2016 ORDER:
This writ petition is filed by petitioners under Article 226 of the Constitution of India seeking to issue a writ, order or direction, more in the nature of writ of Mandamus declaring the inaction of the 3rd respondent in conducting proper enquiry and adding the 4th respondent as accused in Crime No.8 of 2016 of P.S. Kakinada II Town, East Godavari District, as illegal and arbitrary and consequently, direct the respondents 1 to 3 to conduct proper enquiry into the matter and add the 4th respondent as accused in the said crime.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home and perused the material available on record. This Court is of the view that if the petitioner herein has any grievance about non-inclusion of the 4th respondent herein as accused, she is at liberty to approach the concerned Court by invoking the appropriate provisions of Code of Criminal Procedure.
With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
