THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.7534 of 2019 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by the petitioner/A-2 seeking to dispense with the appearance of the petitioner in C.C.No.81 of 2016 on the file of the learned III Additional Chief Metropolitan Magistrate, Hyderabad, registered for the offences under Sections 403 and 420 read with 34 IPC, against him.

Heard learned counsel for the petitioner/A2, learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

At the hearing, learned counsel for the petitioner submitted that the petitioner is innocent and is not connected with the alleged crime and that the petitioner undertakes to appear before the Court below as and when ordered by it and prayed to dispense with the appearance of the petitioner/A-2 in the aforesaid case before the trial Court on every date of adjournment.

Learned Additional Public Prosecutor submits that since the identity of the petitioner is not in dispute, his presence in the above case may not be necessary on every date of adjournment. 5.

Having regard to the reasons stated in the affidavit, filed in support of the Criminal Petition, the appearance of the petitioner/A-2 in C.C.No.81 of 2016 on the file of the learned III Additional Chief Metropolitan Magistrate, Hyderabad, is dispensed with, except on

the dates whenever his presence is required by the trial Court and he shall be represented by a counsel.

With the above direction, the Criminal Petition is disposed of. 7.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
