THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.17614 of 2014 in Crl.P.No.16368 of 2014 and Crl.P.No.16368 of 2014 Common Order:

The de facto complainant and her counsel Sri K. Ramesh Babu are present. Accused and their counsel Sri Sreenivasa Rao Velivela are present.

Heard both sides and perused the petition.

The de-facto complainant lodged FIR No.52 of 2012 with PS Nandigama against the accused for the offence under Section 498-A IPC and investigation is stated to be pending.

Now the submission of both sides is that at the intervention of elders, both parties have settled their disputes amicably and thereby they entered into a compromise and hence permission may be accorded to them to enter into compromise and quash the proceedings in FIR No.52 of 2012 in the interest of justice. Having regard to the above said submission and considering the fact that it is a matrimonial matter wherein the parties have amicably settled their disputes and even if the investigation is continued and parties are driven to trial, no useful purpose will be achieved ultimately and following the decision reported in Gian Singh v. State of

Punjab and another[1], permission is accorded and this Criminal Miscellaneous Petition is allowed and compromise is recorded as per the terms mentioned in the compromise and consequently the proceedings in FIR No.52 of 2012 of PS Nandigama are hereby quashed. In the result, both the petitions are accordingly disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
