HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.9350 of 2017 Order:

This Writ Petition is filed challenging the action of the respondents 1 to 4 in seeking to evict the petitioners from their lands situated in Survey Nos.1067, 1068/1, 1068/6, 1068/8, 1068/7, 610, 609, 606, 616, 608, 609/a, 621/a, 610/aa, 682, 688, 607, 682, 688/a and 1068, admeasuring Ac.3-18 gts., Ac.5-00, Ac.10-12 gts., Ac.1-27 gts., Ac.1-26 gts., Ac.0-11 gts., Ac.1-29 gts., Ac.0-24 gts., Ac.2-00, Ac.1-32 gts., Ac.0-08 gts., Ac.0-24 gts., Ac.2-00 gts., Ac.0-30 gts., Ac.1-00 gts., Ac.013 gts, ,Ac.0-30 gts., Ac.0-28 gts., and Ac.2-33 gts., respectively, of Janampeta village of Pinapaka Mandal, Bhadradri Kothagudem district, pursuant to an order passed by the second respondent in LTR Case No.38/2016/PNK, dated 18.01.2017.

Learned counsel for the petitioners submits that against the said order, the petitioners preferred an appeal to the first respondent along with an application seeking stay on 06.03.2017. Since no regular officer is posted to discharge the duties of the first respondent and the District Collector is in-charge of the office of the first respondent, the appeal has not been taken up and there is a threat of eviction of the petitioners pursuant to the order passed by the second respondent. In the circumstances, this Writ Petition is disposed of directing the first respondent to dispose of the appeal filed by the petitioners as expeditiously as possible and till disposal of the appeal by the first respondent there shall be interim suspension of the proceedings of the second respondent dated 18.01.2017 passed in LTR Case No.38/2016/PNK. It is needless to observe that the first respondent shall

pass orders in the appeal preferred by the petitioners after hearing the petitioners and the fifth respondent herein. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
