THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Ms. JUSTICE J. UMA DEVI COMMERCIAL COURT APPEAL No. 2 of 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The only grievance of the appellant in this appeal is that the Court below has decided the matter on merits while issuing notice to the respondents.
While we are satisfied that the Court below had not erred in exercising its discretion to issue notice to the respondents, it was not necessary for it to make any observation on merits. Suffice it, therefore, to delete the observations in the order under appeal. We however, see no reason to interfere with the exercise of discretion by the Court below in issuing urgent notice to the respondents.
The appeal is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
