HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.204 OF 2015 ORDER:

Through letter No.419/E1/DH.Nlg/2014 dated 20.12.2014, the 4th respondent has black listed the petitioner for life time. The petitioner assails the black listing on the ground that black listing is effected for no fault of petitioner, the same is violative of principles of natural justice and when the acceptance of offer given by the petitioner is found to be illegal, the petitioner has withdrawn from the tender and thereafter the option available to the respondents is to refund the EMD. There is no obligation to accept to supply goods pursuant to proceedings dated 29.10.2014. The black listing through letter dated 20.12.2014 inter alia is without notice to the petitioner and the reasoning in writ petition No.39209 of 2014 has bearing on the disposal of the present writ petition. The writ petition is ordered by setting aside the letter dated 20.12.2014. The respondents are directed to consider the case of petitioner along with other tenderers pursuant to tender notice dated 07.01.2015 and take a final decision within a period of one week from today.
