HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 1978 OF 2015 ORDER:

At the admission stage, the following order is passed. Having regard to the fact that the charge sheet has been filed against petitioners/accused for the offence under Section 498-A IPC read with Sections 3 & 4 of Dowry Prohibition Act and as there is prima facie accusation contained in the charge sheet, it is not a fit case to quash the proceedings. However, considering the submission of learned counsel for petitioners that petitioners attendance in the trial court may be dispensed with on the ground that some of the petitioners are aged and some of them are women, the presence of petitioners/A2 to A5 in CC No. 809 of 2013 on the file of First Additional Judicial Magistrate of First Class, Kothagudem, Khammam District, is dispensed with except on the occasions when the trial court requires their attendance.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
