THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION NO. 22136 of 2017 ORDER :

Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not providing police protection to the petitioner's land, despite the orders of the learned Agent to Government dated 21.06.2016, passed in I.A.No.108 of 2016 in O.S.No.69 of 2015, as illegal and arbitrary. 3.

The grievance of the petitioner is that inspite of the orders passed by the civil Court in I.A.No.108 of 2016 in O.S.No.69 of 2015, and though the RDO, Kothagudem, has instructed the Divisional Superintendent of Police, to provide police protection, but till date no action has been initiated and no police protection has been granted to the petitioner.

Learned Government Pleader for Home, on instructions, would submit that the petitioner has not approached the police seeking police protection.

It is to be noted that the question of petitioner approaching the police seeking police protection would not arise, for the reason that on 17.08.2016, the RDO, Kothagudem informed the Divisional Superintendent of Police, marking a copy of the same to the SHO, to give police protection to the petitioner so as to enable him to cultivate his land, as per the orders of the Sub Divisional Magistrate

and Special Assistant Agent to Government, Mobile Court, Bhadrachalam. Inspite of the same, no explanation is forthcoming. It is not the case of the petitioner that the order was not served on them, nor was it communicated to them.

Having regard to the above circumstances, the writ petition is disposed of directing the respondent police to immediately comply with the order dated 21.06.2016 passed in I.A.No.108 of 2016 by the Sub Divisional Magistrate and Special Assistant Agent to Government, Mobile Court, Bhadrachalam, as early as possible, not later than one week from today. No costs.

Consequently, miscellaneous petitions, if any pending, shall stand closed.
