M/S Atc India Tower Corporation Private Limited v. The Commissioner Of Police
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.29089 OF 2011 DATED: 12.06.2015 Between:
M/s. ATC India Tower Corporation Private Limited Rep. by its Authorised Person Srinivas Banda .. Petitioner And The Commissioner of Police, Cyberabad, and others.
.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.29089 of 2011 ORDER:
This writ petition was filed assailing the alleged inaction of the police authorities upon the petitioner company's complaint dated 04.10.2011 and in providing protection to the staff of the petitioner company during the erection of a cellular tower pursuant to the permission granted by the Greater Hyderabad Municipal Corporation.
By order dated 09.04.2012, this Court took note of the fact that the Greater Hyderabad Municipal Corporation had issued permission under its proceedings dated 18.06.2011 for installation of the telecom tower at the subject site and directed
the police authorities to give all possible protection to the staff of the petitioner company for erection of its cellular tower in terms of the said permission. This Court however left it open to the private respondents herein to question the permission granted to the petitioner company for the installation of its tower in accordance with law, if they were aggrieved thereby.
Ms. Manjusha, learned counsel representing Mr. Sreenivasa Rao Velivela, learned counsel for the petitioner company, states that police protection was provided in terms of the interim order during the installation of the cellular tower. That being so, the main prayer in the writ petition has worked itself out and no further orders need to be passed by this Court. Needless to state, it would be open to the private respondents to take action in accordance with law, if they are aggrieved by the installation of the tower by the petitioner company as per the permission granted to it by the Greater Hyderabad Municipal Corporation. The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
