Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner states that he made an appeal before the 3rd respondent, which is numbered as file No.D/7726/2012. The petitioner filed a copy of the notice issued by the 3rd respondent fixing date of hearing as 05.12.2015.
Learned counsel for the petitioner however, states that though the petitioner was present, the appeal was not heard and was adjourned. It is also stated that since 2012 the petitioner's appeal is pending, the 3rd respondent may be directed to expeditiously hear and dispose of the same.
It is evident from the copy of the notice that the date of hearing was fixed as 05.12.2015, but appeal appears to have been adjourned. Since the petitioner is aged 85 years and he is a senior citizen, I deem it appropriate to direct the 3rd respondent to fix an early date, hear the parties and decide the appeal expeditiously preferably within a period of three months from the date of receipt of a copy of this order. With the above observation, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
