HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37383 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents 1 and 2 in interfering with the civil disputes relating to agricultural land, more particularly as described in plaint schedule in O.S. No.38 of 2015 on the file of Senior Civil Judge, Nandigama, Krishna District, as illegal and arbitrary and consequently, direct the 1st respondent not to interfere with the civil disputes. Heard and perused the material available on record. The grievance of the petitioner is that respondents 4 and 5 are the elder brother and father, respectively, of the petitioner and there are civil disputes between them and civil suits are also pending in that regard.

At the instigation of the respondents 4 and 5, the 1st respondent is interfering in the civil matters and calling the petitioner to the police station, and forcing him to settle matter with the respondents 4 and 5. Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction: " The 1st respondent is directed not to interfere with the affairs of the petitioner and the respondents 4 and 5, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the 1st respondent to register a case, if any complaint is lodged against the petitioner for cognizable offence." There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
