HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8078 of 2016 O R D E R:- Heard learned counsel for the petitioner and learned Government Pleader for Endowments appearing for the respondents.
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking a writ of mandamus declaring the inaction on the part of the respondents in finalizing the extension proposal of Renovation Committee constituted in respect of Sri Bramaramba Mallikarjuna Swamy Temple (Mallanna Temple) situated at Bakaram, Musheerabad, Secunderabad, as illegal and arbitrary.
It is the case of the petitioner that based on the recommendations of the Assistant Commissioner of Endowments, Secunderabad, as well as the Commissioner of Endowments, Hyderabad, 2nd respondent herein, the Government issued G.O.Rt.No.374, Revenue (Endowments.II) Department, dated 07.08.2015, constituting a "Renovation Committee"
to Sri Bramaramba Mallikarjuna Swamy Temple (Mallanna Temple) situated at Bakaram, Musheerabad, Secunderabad, for a period of four months.
The said Committee consists of five members including the petitioner. Thereafter, the petitioner along with other members submitted a representation to the 2nd respondent on 16.11.2015 seeking extension of the time by one more year, as the developmental works are yet to be completed. It is also the case of the petitioner that though there is the Executive Officer of the Temple to carry out the works, the assistance of the members of the Committee is necessary for him.
The grievance of the petitioner is that though the representation was made on 16.11.2015, no orders are passed thereon by the 2nd respondent so far.
As it is evident from letter No.B/404/2015 dated 13.05.2015 of the Assistant Commissioner of Endowments, Secunderabad, recommending the petitioner and four others as members of Renovation Committee, their active involvement in development of the Temple cannot be denied. In that view of the matter and in the facts and circumstances of the case, pending disposal of the representation of the petitioner dated 16.11.2015 by the 2nd respondent, the petitioner may be allowed to participate in the developmental works by way of assisting the Executive Officer of the Temple, without any involvement in the financial matters of the Temple.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions if any pending shall stand closed.
