HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7416 of 2017 ORDER:

Heard learned counsel for the petitioner/ sole accused of C.C.No.304 of 2017 on the file of the II Additional Judicial Munsif Magistrate-cum-Juvenile Court, Ongole, Prakasam District, where the learned Magistrate taken cognizance for the offences punishable under Section 304-A IPC and Section 75 of the Child Care Protection Act and also heard learned Public Prosecutor representing the State before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition, F.I.R., police final report and the other material on record.

A perusal of the material on record no way enables this Court to interdict the trial including any hearing on charges, but for, left open to urge all available defences before the trial Court, if necessary, by filing an application for discharge to decide on own merits. Needless to say, if any application filed under Section 205 Cr.P.C., by the petitioner being the Principal of the Government College has day-to-day responsibility for the administration expressed his difficulty to attend the Court personally, learned Magistrate shall consider

Dr.SSRB,J the same with necessary conditions by permitting him to represent through advocate including in any pre-charge enquiry and answering on charges, but for, personal appearance of Section 313 Cr.P.C. examination. Accordingly, the Criminal Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed.
