THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos. 41732 and 42061 of 2016 COMMON ORDER:

These two writ petitions are filed by the accused in Crime No.134 of 2016 on the file of Madikonda Police Station, Warangal seeking to quash the said crime on the ground that the complaint discloses an offence under Section 304 Part-I, but at the best it may come under 304-A IPC.

On a reading of the complaint, this Court felt that it cannot decide the said issue and it is for the Investigating Officer to conduct investigation and file a final report after completion of the investigation.

Since this Court already granted stay of arrest of the petitioners by order, dated 30.12.2016, respondent No.5 is directed to continue the investigation pursuant to the registration of Crime No.134 of 2016 without arresting the petitioners and complete the same as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order. The writ petitions are accordingly disposed of. Miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
