HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.3731 of 2015 ORDER:

This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent in not passing any orders on the application made by the petitioner on 31.12.2014 and 02.01.2015 through his counsel in terms of the orders passed by this Court in WP No.37220 of 2014 dated 22.12.2014, as illegal and arbitrary and for consequential direction to the 2nd respondent to release the vehicle bearing No.AP 28 BV 9729 to the petitioner forthwith.

2. Heard Sri K. Mohan Rami Reddy, learned counsel appearing for the petitioner and the learned Government Pleader for Forest.

3. Earlier, the learned single Judge of this Court in WP No.37220 of 2014 passed an order directing the petitioner to make an application before the Forest Range Officer, Tirupati Range, Chittoor, Chittoor District, seeking interim custody of the vehicle and disposed of the writ petition. The petitioner accordingly made an application before the Forest Range Officer-2nd respondent on 31.12.2014 and on 02.01.2015 through his counsel. The grievance of the petitioner is that the 2nd respondent has not passed any order on the said application.

4. In view of the order passed by the learned single Judge of this Court, the 2nd respondent is under a duty to pass appropriate orders in relation to the interim custody of the vehicle bearing No.AP 28 BV 9729.

5. In the circumstances, the writ petition is disposed of directing the 2nd respondent to dispose of the application of the petitioner dated 31.12.2014 within a period of two weeks from the date of receipt of a

copy of this order, on condition of proper security to his satisfaction. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
