THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.6210 OF 2017 ORDER:

Heard learned counsel for the petitioners and the learned Public Prosecutor, and perused the record.

After arguing for some time, learned counsel for the petitioners submits that the 1st petitioner - A2 is a very old woman and at least an order may be passed dispensing with her attendance before the trial Court.

There are enabling provisions under the Code of Criminal Procedure as well as Criminal Rules of Practice to dispense with the attendance of the accused facing trial.

At this stage, learned counsel for the petitioners intends to withdraw this application without any prejudice to the rights of the petitioners to file discharge application before the trial Court. Liberty is granted to do so.

Accordingly, the Criminal Petition is dismissed as withdrawn. Miscellaneous petitions pending, if any, shall stand dismissed. ____________________ Dr. SHAMEEM AKTHER, J July 27, 2017 KTL
