THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.22513 of 2018 ORDER:

Heard Mr.G.Simhadri, counsel for petitioner and the learned Assistant Government Pleader for Revenue. Mr.Simhadri argued the matter for considerable length of time and has drawn the attention of the Court to a patent mistake namely non-consideration of all the documents on which the petitioner is relying on, while passing the order impugned in the writ petition.

The Assistant Government Pleader objects to the maintainability of writ petition and further contends that the petitioner can work out the remedy by filing appeal before the Revenue Divisional Officer. He further submits that appeal, if is filed, the Revenue Divisional Officer is under obligation to consider the documents and pass orders as are deemed fit including if necessary, to remit the matter to Tahsildar. Prima facie, this Court is of the view that these routine and regular matters which are part of administration of Land Revenue ought not to be entertained under Article 226 of Constitution of India by this Court. The petitioner can be relegated to work out the remedy of appeal before the Revenue Divisional Officer. This Court has no reason to doubt that appeal, if is filed by petitioner, the Revenue Divisional Officer will conduct detailed scrutiny and pass orders as are necessary in the circumstances of the case.

Hence, the writ petition is disposed of by this order: (a) The petitioner is given liberty to file appeal before the Revenue Divisional Officer within four (04) weeks from today, by enclosing a copy of this order.

(b) The Revenue Divisional Officer considers disposing of the appeal as expeditiously as possible preferably within twelve (12) weeks from the date of filing of appeal. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
