HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37237 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the 2nd respondent to release his vehicle.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that he purchased the vehicle in question viz., Tractor and Trailor bearing Regd.No.AP-36-R-5986 & AP36-R-6026 from its owner Kiomire Ravi, who purchased the same by availing financial assistance from Shriram City Union Finance Limited. Due to non-clearance of finance, the petitioner could not get the vehicle registered. But the petitioner is using the said vehicle for the purpose of attending agricultural operations. When the said vehicle was engaged for transportation of sand, the same was seized by the 2nd respondent. The petitioner is no way concerned with the alleged transportation of sand. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following directions: "The 2nd respondent is directed to release the above vehicle bearing Tractor and Trailor bearing Regd.No.AP-36-R5986 & AP-36-R-6026 for interim custody of the petitioner on his executing a personal bond for a sum of Rs,1,00,000/- (Rupees One lakh only) to the satisfaction of the 2nd respondent, subject to final orders to be passed at the time of disposal of above crime. The petitioner is directed to file an

affidavit before the 2nd respondent undertaking that he shall not alienate the vehicle, shall not change the physical features of the same till the disposal of the above crime, and further he shall produce the vehicle as and when required." No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
