THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3550 of 2016 ORDER:
This Criminal Petition is filed by the petitioners-accused Nos.1 to 9 seeking to quash the proceedings against them in CC No.309 of 2012 on the file of the Additional Judicial Magistrate of First Class, Peddapuram, East Godavari District.
Heard and perused the material available on record. The petitioners are alleged to have committed the offences punishable under Sections 448, 323 and 506 r/w.34 IPC. It is alleged that the 1st petitioner is the brother of the de facto complainant and there are civil disputes with regard to ancestral property between them and in that regard, when the de facto complainant and his wife were in their saw mill, the petitioner came there and beat them and threatened them with dire consequences.
Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to interfere with the proceedings against the petitioners in the above CC. At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of the petitioners 1 to 3 and 7 to 9 only is dispensed with before the trial Court, except on the dates on which the trial Judge insists for their presence. The petitioners 1 to 3 and 7 to 9 are directed to be represented through a Counsel before the trial Court on all hearing dates. Accordingly, the Criminal Petition is disposed of.
