SEETHARAMA MURTI WRI T PETI TI ON No.29649 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The applicant in O.A.No.6450 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, is before us aggrieved by the refusal of interim relief under order dated 14.12.2015 passed in the said O.A.

It is stated that the petitioner/applicant and a Deputy Tahsildar, by name, K. Narayan Reddy, were both subjected to departmental action under proceedings dated 16.04.2013. While so, K. Narayan Reddy filed O.A.No.2590 of 2014 before the Tribunal, wherein, by order dated 15.04.2014, the Tribunal directed consideration of his case for promotion to the post of Tahsildar without reference to the disciplinary proceedings pending against him. However, when the said order was cited before the Tribunal by the petitioner/applicant in O.A.No.6450 of 2015, reference was made thereto in para 4 of the order but similar interim relief was refused to him without indicating as to how the Tribunal distinguished both the cases.

In that view of the matter, this Court is constrained to set aside the order dated 14.12.2015 passed by the Tribunal in O.A.No.6450 of 2015 and remit the matter to the Tribunal for consideration afresh on the issue of grant of interim relief. The Tribunal shall pass a reasoned order expeditiously and preferably within four weeks from the date of receipt of a copy of this order given the unnecessary delay which has been occasioned.
