Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ, Order, or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondent in insisting for Clearance Certificate in the mane of claim made by a married daughter form the petitioner for giving him compassionate appointment in RPF is illegal and unconstitutional and consequently direct the Respondents Nos.

1, 2 and 3 to appoint second Writ Petitioner in the suitable post in befitting his educational qualifications on permanent basis in RPF on compassionate grounds without insisting for any Clearance Certificate or any paper from any third parties; The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of SRI K.S.MURTHY Advocate for the Petitioners, and of SRI P.BHASKAR, learned Standing Counsel for Respondent Nos.

Heard the learned counsel appearing for the petitioner and the learned

counsel appearing for the respondents 1 to 3. Having regard to the submissions made on either side the second petitioner is directed to make an application setting out all the facts as to his entitlement for appointment on compassionate grounds and thereafter, the respondents 1 to 3 are directed to pass appropriate orders in accordance with the rules governing compassionate appointment in railways.
